Shafted Series: 1 of 4
The Motorcycle Legal Minute™ was created by Jason Waechter, THE Motorcycle Lawyer, to explain Michigan’s motorcycle law in a short and easy to understand way.
"Motorcyclists Often Get Shafted Under Michigan Law"
Michigan law often shafts motorcyclists. A biker’s right to No-Fault benefits occurs when a car, van or truck is involved in the motorcycle wreck. Even worse, an owner and operator of an uninsured motorcycle is absolutely EXCLUDED from getting any No-Fault benefits.
Am I entiteld to no fault benefits if my motorycle is uninsured?
Even if the motorcyclist just happens to let his insurance lapse, he is excluded from No-Fault benefits. Stated another way: if you are riding your uninsured motorcycle and even if a drunk driver rear ends you, you do not get No-Fault benefits.
Excluded from benefits means you don’t get payment for: Up to 3 years of wage loss, up to 3 years of house chores, medical transportation and, worst of all, PIP Medical. You could get stuck with hundreds of thousands of dollars in medical bills!
No Motorcycle Insurance Means No No-Fault Benefits
Here is some great LEGAL ADVICE: Don’t ever let your motorcycle insurance lapse. All you need is the basic PLPD not to get shafted as described above.
